Overview

Welcome to Hyperfil3D! The terms "we", "us" and "our" refer to Hyperfil3D, a business owned by Francisco Franco, located in Leiria, Portugal (VAT/NIF 237455005). Hyperfil3D operates this store and website, including all related information, content, features, tools, products and services (the "Services"). Hyperfil3D is powered by Shopify, which enables us to provide the Services.

These Terms of Service ("Terms"), together with the policies referred to below, describe your rights and responsibilities when using the Services. Please read them carefully. When you visit, interact with or use our Services, you agree to these Terms and to our Privacy Policy (https://hyperfil3d.com/policies/privacy-policy). If you do not agree, please do not use the Services.

Nothing in these Terms limits or excludes the mandatory rights you have as a consumer under Portuguese and European Union law.

Section 1 — Access And Account

By agreeing to these Terms, you confirm that you are of legal age in your country of residence, or that you are using the Services with the consent of a parent or legal guardian.

To use the Services or place an order, you may need to provide information such as your email address and billing, payment and shipping details. You confirm that the information you provide is correct, up to date and complete.

You are responsible for keeping your account credentials secure and for all activity under your account. You may not transfer, sell or assign your account to anyone else.

Section 2 — Our Products

We make every effort to describe and show our products accurately. Colours and appearance may vary slightly depending on your screen and device settings. Minor surface texture may be visible on some parts; this does not affect fit or performance.

Compatibility information (make, model, generation and year) is provided in good faith. If you are unsure whether a part fits your vehicle, please contact us before ordering and we will confirm compatibility.

Product descriptions may be updated at any time. We may discontinue products and may limit the quantities sold per person, region or order.

Section 3 — Orders

When you place an order, you make an offer to buy. The contract is concluded when we confirm your order by email. We may refuse or cancel an order, for example if a product is unavailable or if there is an obvious pricing error; in that case we will notify you and fully refund any amount paid.

Your rights to cancel, return and request a refund are described in our Refund Policy (https://hyperfil3d.com/policies/refund-policy). Consumers in the European Union have a 14-day right of withdrawal for standard products. Personalised or made-to-order items are excluded from the right of withdrawal, as permitted by law.

Our products are sold to consumers and to professional customers (such as workshops). Bulk or trade orders may be subject to separate conditions agreed in writing.

Section 4 — Prices And Payment

Prices are shown in euros (or converted into your local currency where available) and include VAT where applicable. Shipping costs are shown before you complete your order. For deliveries outside the European Union, import duties, taxes and customs fees may be charged by the destination country and are the responsibility of the buyer.

Prices, discounts and promotions may change at any time, but the price charged will always be the price shown at the time you place your order. Promotions may be subject to their own conditions; in case of conflict, the promotion's conditions prevail.

You confirm that you are authorised to use the payment method you provide.

Section 5 — Shipping And Delivery

Orders are shipped from Portugal. Delivery times shown on the website are estimates and depend on the carrier and destination. Details are available in our Shipping Policy (https://hyperfil3d.com/policies/shipping-policy).

For consumers, the risk of loss or damage passes to you only when you, or a person indicated by you, take physical possession of the goods. If an order arrives damaged, incomplete or is lost in transit, please contact us and we will help you resolve it.

Section 6 — Legal Guarantee Of Conformity

All products benefit from the legal guarantee of conformity provided under Portuguese and EU law (Decree-Law No. 84/2021 for consumers in Portugal). If a product is not in conformity, please contact us at hyperfil3d@gmail.com with your order number and photos, and we will repair, replace or refund it in accordance with the law.

The guarantee does not cover damage caused by incorrect installation, misuse, accidents, use outside the intended application, or incompatibility resulting from incorrect vehicle information provided by the buyer.

Section 7 — Intellectual Property

The Services, including trademarks, the Hyperfil3D name and logo, texts, images, graphics, designs and their selection and arrangement, belong to Hyperfil3D or its licensors and are protected by intellectual property laws.

You may use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify or publish any content from the Services without our prior written consent.

Vehicle makes, models and logos mentioned on this website are trademarks of their respective owners and are used only to describe compatibility. Hyperfil3D is not affiliated with or endorsed by any vehicle manufacturer.

Section 8 — Third-Party Tools And Links

The Services may include tools or links provided by third parties. We do not control third-party websites or tools and are not responsible for their content or practices. Please review their terms before using them.

Section 9 — Relationship With Shopify

Hyperfil3D is powered by Shopify, which enables us to provide the Services. However, any sales and purchases you make in our store are made directly with Hyperfil3D. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sale between you and Hyperfil3D, including any injury, damage or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with Hyperfil3D.

Section 10 — Privacy

All personal information we collect through the Services is subject to our Privacy Policy (https://hyperfil3d.com/policies/privacy-policy) and, where applicable, to Shopify's Privacy Policy. As the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve them.

Section 11 — Reviews And Feedback

If you submit reviews, photos, suggestions or other content ("Feedback"), you grant us a free, worldwide licence to use, reproduce and publish it in connection with the Services. You confirm that your Feedback is truthful, does not infringe the rights of others and does not contain unlawful, offensive or misleading content. We may remove Feedback that breaches these Terms.

Section 12 — Errors And Omissions

Occasionally, information in the Services may contain errors relating to descriptions, prices, promotions, shipping costs or availability. We may correct such errors and, if an order was placed on the basis of an obvious error, cancel it and fully refund you.

Section 13 — Prohibited Uses

You may use the Services only for lawful purposes. You may not use them to breach any law, infringe intellectual property rights, harass or harm others, transmit false or misleading information, send spam, impersonate others, upload malicious code, collect other people's personal data, or interfere with the security or operation of the Services. We may suspend or close accounts that breach these Terms.

Section 14 — Termination

We may suspend or terminate your access to the Services if you breach these Terms. Sections that by their nature should continue to apply (including Intellectual Property, Legal Guarantee, Limitation of Liability and Governing Law) remain in force after termination.

Section 15 — Limitation Of Liability

To the extent permitted by law, Hyperfil3D is not liable for indirect or consequential losses, or for damage resulting from incorrect installation, misuse or use of products for purposes other than those described.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded or limited under applicable law, nor does it affect your statutory rights as a consumer, including the legal guarantee of conformity.

Section 16 — Severability And Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force. These Terms, together with the policies published on this website, constitute the entire agreement between you and Hyperfil3D regarding the Services.

Section 17 — Governing Law And Jurisdiction

These Terms are governed by Portuguese law. This does not deprive consumers resident in another EU country of the protection of the mandatory provisions of the law of their country of residence. Disputes may be brought before the competent courts under the applicable legal rules.

We may update these Terms from time to time by publishing a new version on this page. The version in force at the time you place your order applies to that order.
